New Rules of Court Coming in 2011
The California Rules of Court, including rules concerning appellate procedure have been amended, effective January 1, 2011. The changes have only a minor affect on appellate practice.
Amended rule 8.44(b)(4) states that only one copy of a motion need be filed in the court of appeal, unless the court orders otherwise. The new rules make clear that the word count does not include the signature block. (Rules 8.204(c)(3), 8.360(b)(3), 8.486(a)(6).)
The rules concerning electronic service have been revised. (See rules 8.70 et seq.) Courts of appeal are increasingly encouraging criminal attorneys to file briefs electronically as well as through the mail.
